      KILLED HIS UNCLE,.
John and James Burchell Kill James Rakes and Wound Tom Rakes.

Two or three miles above Bradfordsville, on the South Fork, lived John Burchell and James Rakes, brother-in-law, Burchell having married Rakes' sister. A enmity had existed between them for years, the cause of which had not been distinctly learned. On Saturday last, it was reported, Burchell said that the trouble must be settled on Monday.

Burchell and his son Jim, and Rakes and his son Tom, went to Bradfordsville on Monday to the election. Late in the afternoon they started home. It is said that all of them were well primed with liquor. Burchell and son passed the Rakes on the road, but waited for the Rakes to come up. John Burchell attacked James Rakes, throwing a stone which struck him on the back of the head and felled him to the ground. Rakes called to his son to come to his assistance. About this time Tom Rakes was struck in the thigh by a bullet, which inflicted a serious wound. Burchell then turned his attention to James Rakes remarking, "Ill fix you." As he said this he walked up to James Rakes, as he lay on the ground and shot him in the forehead, killing him. The Burchell's then went on to Rakes' house and were abut to kill John Abell, a son-in law of James Rakes, but for some reason left without effecting this purpose. The Burchells are evading arrest, but will probably soon be captured

[Note from Roger W. Wells: One wonders why John Burchell would kill his brother-in-law. One of my speculations is that in 1867 the John Rakes property was sold by his children. In looking at those who signed the deed, you find all of the children who are living in the area except Mary and John Burchell. Why were they left out? Could this have been a source of contention within the family and cause John and his son to kill James Harrison?]

Two miles above Bradfordsville, John Burchell and his son Jim waylaid and attacked James Rakes and his son Tom. John Burchell struck James Rakes on the head with a stone, knocking him down. Jim Burchell drew a pistol and shot John Rakes through the head as he lay upon the ground, killing him. He also shot Tom Rakes, inflicting a bad wound in the thigh. John Burchell married James Rakes' sister, and a feud of several years' standing existed between the families. The Burchells were not arrested, but an officer is looking for them.

    23. [S996] AA: Conclusion - Death, (Date posted to database 7 Sep 2015).
The following document(s) are used for the conclusion that James Harrison Rakes died on the 4 August 1884 at Marion County, Kentucky, United States.

      Death Date:
The death date comes from the Lebanon Standard Times news article published on the 6th of August 1884. The article states that the shooting occurred on Monday afternoon. Checking the calendar for August 1884 Monday would be the 4th.
[Several of James descendants list his death year as 1882. I don't know where this information come from.]

      Death Location:
The death location in the newspaper article is list the residence of James as two or three miles above Bradfordsville, on the South Fork. This South Fork was know as Rakes Branch. The Shooting occurred on their way home which would be Marion County, Kentucky.

    25. [S997] AA: Conclusion - Marriage, (Date posted to database 3 Sep 2015).
The following document(s) are used for the conclusion that John Rakes and Nancy Saunders were married about 1802 in Buckingham County, Virginia, United States.

The marriage is documented in the Chancery Court case which started in Oct 1830 and ended 1850. The court records document that Nancy Saunders the daughter of Zach Saunders and Jane Radford married John Rakes. This court document does not give a date or place of marriage.

      Marriage Date:
I have set the marriage date between John Rakes and Nancy Saunders as about 1802. This calculation is based on them being married 1 year prior to the birth of their first child, John Rakes Jr who's date of birth is found on his death record as 16 March 1803.

      Marriage Location:
The parents of John and Nancy were living in Buckingham County, Virginia, United States and I list this as the place of marriage. The parents of both John, William Rakes, and Nancy, Zachariah Sanders, are listed in the 1783 tax records of Buckingham County, Virginia during this time period.

There are some who think John Rakes was married more than once. In my looking at all of the documents that I have I do not see and indication of multi marriages. There is a gap in the birth of children but this could be just the fact that we do not know the birth dates of most of the children. It could be because of his service in the war of 1812 and his move to Kentucky. The change of age of the oldest female in the 1840 census is from Nancy's death and the oldest female then being his oldest daughter, Elizabeth, who is still at home.

If the parents of John Rakes Jr, the oldest son, were John and Nancy and the parents of Mary Rakes the, youngest daughter, then John and Nancy would have to separate and then marry again.

    26. [S997] AA: Conclusion - Marriage, (Date posted to database 7 Sep 2015).
The following document(s) are used for the conclusion that James Harrison Rakes and Mary Francis Mattingly were married about 1857 at Marion County, Kentucky, United States.
The 1860 and 1870 census implies that they are married.
The 1880 Census indicates that they are married.

      Marriage Date:
The marriage date is calculated based on the birth of their first child Elizabeth who was born about 4 August 1858.
This date is also given in the International Marriage Records.

      Marriage Location:
The marriage location is taken from the place of residence of James.
[From some historical records there is a small church located close to the Rakes property called the Primitive Church. This would have been as logical place for them to get married but there is no document ion to support this.]
